Scuba Diving Voluntary Release, Waiver and Assumption of Risk

I,/we,the parent(s), guardian(s) of _______________________child’s name, hereby affirm _______________________child’s name is a certified scuba diver, and that I/we thoroughly understand the hazards of scuba diving including those hazards occurring during vehicle and boat travel to and from the dive site, and during use of air compressors and other diving equipment. I/we understand that these hazards include, but are not limited to, air expansion injuries, drowning, decompression sickness, or other hyperbaric injuries that can require treatment in a recompression chamber. I/we understand the hazards of diving can include, but are not limited to slipping or falling, being cut or struck by a boat while in the water, injuries occurring while getting on or off a boat, injuries occurring while using or being in the vicinity of air compressors and compressed air, while breathing compressed air, while using scuba diving equipment, while driving to and from diving locations, and other perils associated with scuba diving and associated equipment. By signing this release, I/we certify that I/we are fully aware of and expressly assume these and all other risks involved in participating in Wet and Wild Diving Society or Alberta Underwater Council (AUC) events.
________I/we further understand that the diving trips may be conducted at a site that is remote, either by time or distance or both, from a recompression chamber or medical assistance. I/we still choose to allow my child to participate in Wet and Wild Diving Society events in spite of the possible absence of a recompression chamber or medical facilities and personnel in proximity to the dive site.
________In consideration of being allowed to participate in Wet and Wild Diving Society events, I/we personally assume all risks in connection with the events for any harm, injury or damage that may befall my child while participating or traveling to and from, including all risks connected therewith, whether foreseen or unforeseen.
________I / we further save and hold harmless the Wet and Wild Diving Society, its servants, agents and representatives from any claim or lawsuit by me / us, my / our family, estate, heirs, or assigns, arising out of my participation in any Wet and Wild Diving Society events, including claims arising both during the event or after.
________I / we also understand skin diving and scuba diving and operation of diving related equipment (including but not limited to tanks, trailer, boat and air compressor operation) are physically strenuous activities, and my / our child will be exerting themself during the Wet and Wild Diving Society events and, if they are injured as a result of a heart attack, panic, hyperventilation, or any other medical condition, I / we expressly assume the risk of said injuries and I / we will not hold the above listed individuals or societies responsible.
________I further state I am of lawful age and legally competent to sign this liability release or I am the parent or guardian.
________I / we understand that the terms herein are contractual and not a mere recital and I / we have signed this document of my / our own free act.
I, we ________________________ BY THIS INSTRUMENT, DO HEREBY EXEMPT AND RELEASE WET AND WILD DIVING SOCIETY, THEIR MEMBERS, REPRESENTATIVES OR AGENTS AND SUCCESSORS, WHETHER NAMED OR NOT, OF ALL RESPONSIBILITY AND LIABILITY FROM PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR PRODUCT LIABILITY, OR RESULTING FROM ANY ACCIDENT OR MISHAP THAT MAY OCCUR DURING OR IN RELATION TO THE EVENTS AND ACTIVITIES OF THE WET AND WILD DIVING SOCIETY. I HEREBY INDEMNIFY AND SAVE WET AND WILD DIVING SOCIETY AND AUC HARMLESS FROM AND AGAINST ALL CLAIMS, DEMANDS, LOSSES, COSTS AND EXPENSES IN ANY MANNER BASED UPON, ARISING OUT OF OR CONNECTED WITH WET AND WILD DIVE SOCIETY AND AUC EVENTS AND ACTIVITIES. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK BY READING IT BEFORE I SIGNED IT ON BEHALF OF MYSELF / OURSELVES AND MY / OUR HEIRS.
